挺不错的私法史书籍，在发展的洪流中，法律如何发展。在我们不断仰望民法典的今天，应该看看法律如何变迁。
评分其实读的不是这个版本，但内容没区别就权且这么记录了。一部经典的法律史作品，主要讲两个问题一条主线:一是法律是在不断演变的，二是美国法律的演进是工具主义的，即为了美国的经济发展而服务。所以主线就是经济发展。说说我以为的不足:不是说经济发展作为演进的动力有什么问题，而是觉得这种单一线性关系不足以支撑法律史的进程。本书暗示了从经济发展到法律制定的单向关系以及，暗示了法律的演变始终落后于经济发展的脚步，这可能不是那么太符合历史甚至，可以说是隐含了用先后顺序部分代替因果关系的问题。而最新的制度研究其实也说明了诸如法律这样的制度和经济之间的关系是复杂的，可能更类似福格尔说的协同演化。
