著者簡介

H.L.A.哈特（1907-1992），前牛津大學法理學講度教授，英國法理學傢，新分析實證主義法學創始人，20世紀英語世界最為偉大的法學傢。哈特以其實證主義的姿態、自由主義的立場、分析主義的旗幟以及道德哲學傢的情懷，構建瞭一個龐大而自洽的法理學體係。在其之前，20世紀中期的（英語）政治哲學瀕於消亡，法律哲學也奄奄一息；而在他之後，卻是分析法學大行其道，法理學界眾神喧嘩。所以，當代英美著名法學傢科爾曼、拉茲等人認為是哈特拯救瞭西方（英美）的政治哲學和法哲學。哈特梳理和加強瞭法律哲學與道德以及政治哲學之間的聯係，法哲學與精神哲學和邏輯哲學的聯係－－在此任何一個主題上，他都做齣瞭嚴肅的貢獻。而且，沿循邊沁的腳步，在道德哲學與政治哲學領域裏，他是自由主義傳統最強大的代言人。

他的作品包括：《法律的概念》（1961，1994）；《法律、自由與道德》（1968）；《懲罰與責任》（1968）；《法律中的因果關係》（與A.M.奧諾裏閤作，第二版，1985）以及《論邊沁》（1982）。

哈特認為國際法裏沒有次級規則，但在這本書齣版之後，Roberto Ago卻把次級規則的概念引入瞭國際法。有時候曆史就是這樣諷刺又有趣。

Second-time, for Prof. Leiter's Jurisprudence; convention + attitude (deem as obligation, but motivation various) - primary and secondary rule (rule of recognition); indeterminacy small, and results in open texture of language; soft positivism: RR can include content-based validity test, but must have pedigree-based ones.
