Brown v. Board of Education, the Supreme Court's landmark 1954 decision ordering the desegregation of America's public schools, is perhaps the most famous case in American constitutional law. Liberals and conservatives alike harbor profound regrets about the development of race relations since Brown, while disagreeing heatedly about the proper role of the courts in promoting civil equality and civil rights. In this volume, nine of America's top constitutional and civil rights experts have been challenged to rewrite the "Brown" decision as they would like it to have been written, incorporating what they now know about the subsequent history of the United States but making use of only those sources available at the time of the original decision. In addition, Jack Balkin gives a detailed introduction to the case, chronicling the history of the litigation in "Brown", and explaining the current debates over its legacy. 评分似乎没有roe v. wade那本好看,可能也是隔离本身不再是个有争议性的问题了,仍然有问题的是affirmative action和equal opportunity to education,所以很多讨论是围绕这个展开的。balkin的导言和判决写得特别清楚,后面很多反而没什么耐心看……
评分布朗案判决可能是美国宪政史上最不像法律判决的一份判决书。马歇尔时代确立的,靠严密扎实法律推理实现政治捭阖的传统,走在这里开始剥下逻辑的外衣,只剩博弈转圜了。把沃伦所有高调花哨的论证拆开来看,细节之处充满了立场的矛盾与论据的双标。贝尔教授的异议大概道出了令人失望的事实:和民权运动史上的许多事件一样,布朗案也许不配成为人们心目中那个划时代的判决,抽丝剥茧,它只是政治斗争顺风车的又一个产物。
